The Supreme Court of India issued a sensational order on bulldozer actions. The Supreme Court has placed a ban on the bulldozer operation across the country. The next hearing of the case will be held on October 1 in the Supreme Court. The Supreme Court said that the action should be taken only after taking their permission until further investigation. Bulldozer operation has now been banned till October 1 as per Supreme Court instructions. However, the court made it clear that this instruction does not apply to illegal structures blocking roads, footpaths and railway lines. After hearing the arguments of all parties, the Supreme Court said it will frame guidelines for implementation across the country regarding bulldozer actions.
A bench comprising Justice BR Gavai and Justice KV Viswanathan passed the orders on a petition filed by various state governments against the action of demolishing the buildings of the accused as a punitive measure. The Supreme Court has issued orders that bulldozer operations will not be carried out anywhere in the country till October 1 without their permission.
In a petition filed in the Supreme Court on behalf of Jamiat Ulema-e-Hind, it has been stated that bulldozer actions are being taken targeting some of the BJP-ruled states. During the hearing, Solicitor General Tushar Mehta objected to the Supreme Court order. In this way the hands of the officials cannot be tied. However, the bench refused to show indifference saying that if the demolitions are stopped for a week, the ‘sky will not fall’. The bench said that these orders were passed in exercise of special powers under Article 142 of the Constitution. Justice Viswanathan said during the hearing that there is only one instance of illegal demolitions which is against the spirit of the Constitution.
