    Supreme Court to Review Constitutionality of New CEC Appointment Law

    New Delhi, January 11, 2025: The appointment of the next Chief Election Commissioner (CEC) in India will follow the procedures outlined in the Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service, and Term of Office) Act, 2023, instead of traditional conventions. Under this legislation, the President of India will appoint the CEC based on recommendations from a selection committee consisting of the Prime Minister, the Leader of the Opposition in the Lok Sabha, and a Union Cabinet Minister nominated by the Prime Minister, excluding the Chief Justice of India.

    The Supreme Court is expected to review the new statute for its constitutionality. The review will assess whether the revised appointment process maintains the Election Commission’s integrity and independence, which is crucial for conducting free and fair elections in the country. This examination will shape the future framework for the CEC’s appointment.
